Individuals under 18 should use the website and participate in ECI programs with the involvement and permission of a parent or legal guardian where appropriate.
4. ACCEPTABLE USE
You agree to use the website only for lawful purposes and in a manner consistent with ECI’s charitable mission.
You may not:

5. DONATIONS
Donations made through the website are voluntary charitable contributions intended to support ECI’s mission, programs, operations, and community initiatives.

Donations may be processed by an independent payment processor. By submitting a donation, you authorize the applicable processor to charge the payment method you provide.
You represent that:

- The donation does not involve fraud or unlawful funds

B. Use of Donations
Unless a donation is accepted subject to a specific written restriction, ECI retains discretion and control over the use of donated funds in furtherance of its charitable mission.
When a campaign, event, or program receives more funding than is reasonably required, becomes impractical, is delayed, or is discontinued, ECI may redirect remaining funds to a related purpose or another area of greatest organizational need, to the extent permitted by law and any applicable written restriction.
Statements describing the intended use of donations reflect ECI’s good-faith plans at the time they are made but do not constitute a guarantee that every program, project, event, or outcome will occur exactly as described.
C. Donation Refunds
Charitable donations are generally final and nonrefundable.
ECI may consider a refund request involving:
- A duplicate transaction
- An incorrect donation amount
- Unauthorized use of a payment method
- A documented processing error
- Another exceptional circumstance
Refund requests should be submitted promptly to info@echadinitiative.org. Approval is within ECI’s reasonable discretion unless a refund is required by law.
D. Recurring Donations
If you authorize a recurring donation, your selected payment method may be charged at the frequency disclosed when you enroll.
You may request cancellation of future recurring charges by using any available account or cancellation feature or by contacting ECI. A cancellation request may not reverse a payment already processed.
E. Tax Matters
ECI will provide donation acknowledgments or receipts when appropriate. The donor is responsible for determining the tax treatment and deductibility of a contribution.
The value of any goods or services provided in exchange for a payment may reduce the deductible portion of that payment. Donors should consult a qualified tax professional regarding their individual circumstances.
Nothing on the website constitutes tax, accounting, financial, or legal advice.
6. EVENT AND PROGRAM REGISTRATION
Submitting a registration or application does not guarantee admission, participation, assistance, or receipt of any item or service.
Participation may be subject to:
- Available capacity
- Eligibility requirements
- Registration deadlines
- Geographic or program restrictions
- Verification of submitted information
- Safety requirements
- Codes of conduct
- Parent or guardian consent
- Media or liability releases
- Event-specific rules
- Availability of funding, volunteers, facilities, supplies, or donated items
ECI may approve, deny, limit, postpone, modify, or cancel a registration, program, benefit, or event when reasonably necessary.
Event dates, locations, schedules, activities, speakers, benefits, gifts, and other details may change. ECI will make reasonable efforts to communicate material changes using the contact information provided during registration.
7. CHILDREN’S PROGRAMS
ECI may offer programs and events that serve children and families.
A parent or legal guardian registering a minor represents that:
- They have authority to register the child
- The information submitted is accurate
- They will disclose information reasonably necessary for the child’s safety
- They will comply with applicable pickup, supervision, and participation requirements
- They understand that event-specific consent or release forms may be required
Unless ECI expressly agrees otherwise in writing, a child’s participation in an event does not create an ongoing custodial, educational, medical, counseling, childcare, or supervisory relationship between ECI and the child.
Parents and guardians remain responsible for complying with the supervision requirements communicated for each event.
If another adult is authorized to transport or pick up a child, the parent or guardian is responsible for providing accurate authorization information. ECI may request identification before releasing a child to an authorized adult.
8. VOLUNTEERS
Submitting a volunteer application does not guarantee a volunteer position.
ECI may establish eligibility, screening, training, background-check, confidentiality, safety, or supervision requirements for particular volunteer roles.
Volunteers must:
- Follow ECI policies and instructions
- Protect confidential information
- Maintain appropriate boundaries
- Treat participants and other volunteers respectfully
- Comply with safety and child-protection procedures
- Avoid representing personal views as official ECI positions
- Immediately report safety concerns or suspected misconduct through the appropriate channel
ECI may decline, restrict, suspend, or end a volunteer relationship at any time, subject to applicable law.
Volunteer participation does not create an employment relationship or an entitlement to wages, benefits, reimbursement, or future employment unless expressly agreed in writing.
9. EMERGENCIES AND REQUESTS FOR ASSISTANCE
ECI’s website, email, telephone number, social-media accounts, and online forms are not emergency-response services and may not be monitored continuously.
If you or another person is experiencing an emergency, immediate danger, or urgent medical or mental-health crisis, contact 911 or the appropriate local emergency service.
Submitting a request through our website does not guarantee:
- An immediate response
- Financial assistance
- Housing
- Medical care
- Legal representation
- Counseling
- Transportation
- Food, toys, gifts, or supplies
- Acceptance into a program
- Referral to another provider
ECI may prioritize requests based on its mission, eligibility standards, urgency, available resources, funding, and organizational capacity.

You retain ownership of content you own.

21. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless ECI and its directors, officers, employees, volunteers, and authorized representatives from claims, losses, liabilities, costs, and reasonable expenses arising from:

- Your material violation of these Terms
- Fraudulent or intentionally misleading information you submit
- Content you submit that violates another person’s rights
- Your unauthorized use of ECI’s name, logo, or intellectual property

Subject to any applicable law requiring otherwise, legal proceedings arising from these Terms or use of the website shall be brought in a court of competent jurisdiction located in Nye County, Nevada, or the applicable federal court serving that area.
Before filing a legal action, the parties are encouraged to make a good-faith effort to resolve the matter through written communication.
24. CHANGES TO THESE TERMS
ECI may update these Terms periodically to reflect changes in our website, programs, operations, technology, or legal obligations.
Revised Terms will be posted on our website with an updated “Last Updated” date. Changes become effective when posted unless another effective date is stated.
Your continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms.
25. SEVERABILITY
If any provision of these Terms is held invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or severed if necessary. The remaining provisions will continue in effect.
26. NO WAIVER
ECI’s failure to enforce a provision of these Terms does not waive its right to enforce that provision or another provision later.
27. ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without ECI’s prior written consent.
ECI may assign these Terms to a lawful successor or affiliated organization in connection with a restructuring, transfer of programs, merger, or similar organizational change.
28. ENTIRE AGREEMENT
These Terms, the Privacy Policy, and any applicable event-specific registration, consent, release, donation, volunteer, or program agreement constitute the applicable agreement between you and ECI concerning your use of the website and related services.
If an event-specific or program-specific written agreement conflicts with these general Terms, the more specific agreement will control for that event or program.
